Appeal Policy
We are committed to ensuring that any person depicted in content published on our website has a clear and accessible process to appeal for the removal of such content. We take all appeals seriously and will review each request fairly and promptly.
Right to Appeal
Any person who is depicted in content available on our website may submit an appeal requesting the removal of that content.
An appeal may be submitted where the person depicted believes that:
- They did not provide consent for the content to be published; or
- Their consent was not valid or is void under applicable law; or
- There are other circumstances that provide a legal or policy basis for removal of the content.
How to Submit an Appeal
To submit an appeal, please contact us through our Contact Us page or by email and provide the following information:
- The URL or other specific location of the content in question;
- A description of the content and identification of the person depicted;
- A statement explaining your relationship to the content;
- The reason for requesting removal, including whether consent was not provided or whether previously provided consent is void or otherwise invalid under applicable law; and
- Any supporting information or documentation that may assist us in reviewing the appeal.
We may request additional information where reasonably necessary to verify the request and conduct our investigation.
Appeal Review Procedure
Upon receiving an appeal, we will:
- Acknowledge receipt of the appeal;
- Review the content identified in the appeal and the circumstances surrounding its publication;
- Consider any information or documentation submitted by the person making the appeal and, where appropriate, information available from other relevant parties;
- Determine whether consent was provided and whether that consent was valid under applicable law; and
- Communicate the outcome of the appeal to the person who submitted it.
We will resolve appeals within five business days of receiving all information reasonably necessary to complete our review.
Removal of Content
If our investigation determines that the person depicted did not provide consent for the content to be published, or that the consent provided is void or otherwise invalid under applicable law, we will promptly remove the relevant content.
Where appropriate, we may also take additional action in accordance with our policies and applicable law.
Disagreement Regarding an Appeal
If the person submitting an appeal disagrees with the outcome of our appeal review, they may request that the disagreement be resolved by a neutral body.
We will allow such disagreements to be submitted to a neutral body for independent resolution. The merchant will bear the expense of the neutral resolution process.
The neutral resolution procedure is as follows:
- The person submitting the appeal informs us that they disagree with the appeal decision and wish to use neutral resolution;
- We acknowledge the request and provide information regarding the available neutral body and the applicable procedure;
- The dispute is submitted to the neutral body for independent review;
- The neutral body reviews the relevant information and documentation provided by the parties; and
- The neutral body issues its decision in accordance with its applicable procedures.
We will cooperate fully with the neutral body and provide any information reasonably required for the resolution of the disagreement.
Confidentiality
We will handle appeals and supporting information responsibly and in accordance with applicable privacy and data protection requirements. Information relating to an appeal may be shared where reasonably necessary to investigate the request, comply with applicable law, or facilitate neutral resolution of a disagreement.
